TERMS & CONDITIONS

Welcome to the Cam XI online store (“Store”), operated by Cam XI (“Cam XI,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your access to and use of this website, any purchases made through the Store, and any related services.


By accessing this Store or placing an order, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use this website or purchase products from us.


These Terms apply to all visitors, customers, and users regardless of their location.




1. Business Information


Cam XI operates an independent artist merchandise and music business based in the Province of Nova Scotia, Canada.


Products may include, but are not limited to:



  • Apparel

  • Hats

  • Accessories

  • Posters

  • Signed merchandise

  • Physical music releases

  • Digital downloads

  • Collectibles

  • Limited edition products

  • Promotional items

  • Gift cards (if offered)

  • Future products and services




2. Eligibility


By using this Store, you represent that:



  • You are at least the age of majority in your jurisdiction or have the permission of a parent or legal guardian.

  • The information you provide is accurate and complete.

  • You have the legal authority to enter into a binding agreement.

  • You will not use the Store for unlawful or fraudulent purposes.




3. Orders


Submitting an order does not guarantee acceptance.


We reserve the right to:



  • refuse any order;

  • limit quantities;

  • cancel suspicious transactions;

  • decline orders suspected of fraud;

  • cancel pricing errors;

  • refuse service where permitted by law.


If payment has already been processed for a cancelled order, an appropriate refund will be issued.




4. Product Availability


Products may be produced in limited quantities.


Certain merchandise may:



  • sell out without notice;

  • be discontinued;

  • be replaced with updated versions;

  • vary slightly in appearance due to manufacturing differences, monitor settings, lighting, or photography.


We make reasonable efforts to display products accurately but cannot guarantee every screen reproduces colours identically.




5. Pricing


All prices are displayed in the currency specified on the Store.


Unless otherwise stated:



  • taxes may be added where required;

  • shipping charges are calculated separately;

  • customs duties are the responsibility of the customer unless explicitly stated otherwise.


Prices may change without notice.




6. Payment


Payments are securely processed through third-party payment processors.


We do not store complete payment card information.


Accepted payment methods are those displayed during checkout.


If a payment is declined, we may cancel the order without further obligation.




7. Shipping


Shipping estimates are estimates only.


Delivery times may vary due to:



  • weather;

  • customs inspections;

  • postal delays;

  • labour disruptions;

  • carrier delays;

  • international regulations;

  • events outside our reasonable control.


Ownership and risk of loss transfer to the customer upon delivery to the shipping carrier unless otherwise required by applicable law.


Customers are responsible for ensuring their shipping address is accurate before completing checkout.


Returned shipments caused by incorrect addresses may require additional shipping charges before reshipment.




8. International Orders


Customers ordering outside Canada acknowledge that:



  • import duties;

  • VAT;

  • customs fees;

  • brokerage charges;

  • local taxes


may apply.


These charges are determined by local authorities and are the customer’s responsibility.


We cannot estimate these charges in advance.




9. Pre-Orders


Some merchandise may be offered as pre-orders.


Estimated release dates are estimates only.


Production schedules may change due to manufacturing, supply chain issues, artist scheduling, shipping disruptions, or other unforeseen circumstances.


Ordering a pre-order item indicates your acceptance that delivery may occur later than initially estimated.


Where legally required, refunds for delayed pre-orders will be provided in accordance with applicable law.




10. Limited Edition Merchandise


Limited edition products are available only while supplies last.


Once sold out, they may never be reproduced.


We reserve the right to determine whether any future re-release differs materially from the original edition.


Descriptions such as “limited,” “numbered,” or “exclusive” reflect our intentions at the time of sale but do not constitute a guarantee of future production decisions unless expressly stated.




11. Digital Products


Digital products include, but are not limited to:



  • downloadable music;

  • digital artwork;

  • wallpapers;

  • sample packs;

  • bonus content;

  • exclusive media.


Unless otherwise stated, digital purchases grant you a personal, non-exclusive, non-transferable, revocable licence to use the content for your own private enjoyment.


You may not:



  • redistribute;

  • upload;

  • resell;

  • sublicense;

  • commercially exploit;

  • modify for resale;

  • share download links;

  • remove copyright notices.


Unauthorized distribution may result in termination of any licensing active and other legal remedies.

12. Intellectual Property and Artificial Intelligence Restrictions


Unless otherwise indicated, all content available through this Store—including but not limited to music, lyrics, recordings, artwork, photographs, graphics, logos, designs, product descriptions, videos, text, branding, merchandise designs, and other original content—is the exclusive property of Cam XI or its licensors and is protected by Canadian and international intellectual property laws.


No content from this Store may be copied, reproduced, distributed, modified, republished, displayed, performed, reverse engineered, scraped, harvested, indexed, or otherwise used without prior written permission, except as expressly permitted by applicable law.


Without limiting the foregoing, you may not use any content from this Store for the purpose of training, developing, testing, validating, fine-tuning, or improving any artificial intelligence, machine learning, large language model, generative AI system, dataset, algorithm, or similar technology without our prior written consent.


This prohibition includes automated scraping, crawling, text and data mining, dataset creation, embedding generation, synthetic data generation, model evaluation, or any substantially similar activity, whether conducted directly or through a third party.


Any unauthorized use of our content may constitute copyright infringement, breach of these Terms, and any other violation of applicable law. We reserve the right to pursue all remedies available, including injunctive relief, monetary damages, recovery of legal costs where permitted, and any other relief available under applicable law.
